I feel the background is maybe a little too cluttered – you could try cropping down to remove the sky, so that the background has one less element and is less distracting but still gives a sense of perspective or… remove the land completely so you loose the feeling of distance and it is more a flat canvass, which makes it a little more abstract (and the lack of focus a more positive attribute than negative)
Just a couple of ideas!

I would say the bird is not a common seagull ... I wonder about the spott behind the eye ...Otherwise agrees with mandanapale

Little blurry but nice job capturing a moving "uncommon" seagull!
